Terms of Service
In short: these terms are the agreement between EduNexus and each school that uses it. The school owns its records, pays per term for its package and SMS credits, and is responsible for how its staff use EduNexus.
1. The agreement
These Terms of Service, our Privacy Policy and our Data Processing Agreement form the agreement between EduNexus (“we”) and the school using EduNexus (“the school”). The person who registers the school confirms they are allowed to accept them for the school. Staff, students and parents who use EduNexus through the school must also follow the rules on acceptable use below.
2. The service
EduNexus is an online school management system: student records, scores, results and report cards, mock examinations, attendance, fees, messages to parents and a student and parent portal. Which parts a school can use depends on its package. We may improve EduNexus and change features over time; we will not remove a main feature a school has paid for during that paid period.
3. Free trial
New schools may use EduNexus free for a trial period as offered on our website. At the end of the trial the school can choose a paid package; if it does not, access is reduced or paused, and the school's records are kept as described in the Privacy Policy.
4. Fees and payment
- Packages are paid per school term at the prices shown in EduNexus when the school pays. Discounts for paying several terms at once are applied as shown at the time.
- SMS credits are bought separately. One credit is used for each SMS page sent; credits used for messages that were sent are not refunded, even if a network does not deliver the message.
- If a payment is late, the school has a short grace period, after which access may be limited until payment is made. Records are not deleted because of late payment.
- Payments made are not refundable except where the law requires it or we agree in writing.
5. Accounts and security
The school's administrator creates and manages staff accounts and decides what each person can see. The school must keep passwords private, remove access for staff who leave, and tell us promptly if it suspects someone has misused an account.
6. The school's responsibilities
- The records the school enters are its own responsibility: they must be accurate, and the school must have a lawful reason — and parents' or guardians' consent where required — for the personal information it enters, especially optional details such as religion and health.
- The school decides which messages to send to parents and is responsible for their content. Messages must be about the school's own students and activities; EduNexus must not be used to send spam or advertising for others.
- Report cards, transcripts and certificates are issued in the school's own name and are the school's responsibility. Mock examination certificates are for practice and are not WAEC certificates.
- The school must follow the laws that apply to it, including the Data Protection Act, 2012 (Act 843), and register with the Data Protection Commission if the law requires.
7. Acceptable use
No one may use EduNexus to break the law; to harass, threaten or harm anyone; to upload harmful files; to try to get into another school's records or bypass security; to share log-ins outside the school; or to copy or resell EduNexus. We may suspend accounts that do.
8. The school's records
The school owns the records it puts into EduNexus. We use them only to provide EduNexus to the school, as described in the Privacy Policy and Data Processing Agreement. The school can ask us for a copy of its records at any time.
9. Availability and support
We work to keep EduNexus available and its records safe, but we cannot promise it will never be interrupted — for example during maintenance, internet or network problems, or problems at our providers. SMS and WhatsApp delivery depends on the mobile networks. We provide support by phone and WhatsApp during reasonable hours.
10. Ending the agreement
A school may stop using EduNexus at any time. We may suspend or end a school's access for non-payment or a serious breach of these terms, after giving notice where reasonable. When a school leaves, its records are handled as described in the Privacy Policy and Data Processing Agreement.
11. Our liability
As far as the law allows, EduNexus is provided “as is”. We are not liable for indirect losses, such as lost income or opportunity, or for losses caused by the school's own records, decisions or staff. Our total liability for any claim is limited to the fees the school paid us for the term in which the claim arose. Nothing in these terms limits liability that cannot be limited by law.
12. Changes to these terms
We may update these terms. We will tell schools about important changes before they take effect; continuing to use EduNexus after that means the school accepts them.
13. Law
These terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction.
